Referendum in Catalonia still divides Spain

"In a democracy we must solve the challenges facing us in the future, democratically. No one can scare up by someone wanting to express their opinion with a vote in an urn. The Constitutional Court can challenge the referendum of 9 November in Catalonia?

Francesc de Carreras:

The Government can present a challenge to the Constitutional Court, as provided for in article 161-2 of the Constitution, which requires the suspension of the referendum, and the judge must apply the Constitution. That is, from a legal point of view, it is impossible to hold the referendum on November 9. It's another thing to organize a vote, and appears to be fictional that you want to do some pro-independence parties.

The Prime Minister, Mariano Rajoy, can impugn the responsible for the Catalan region, Artur Mas, and suspend the autonomy of the region?

Francesc de Carreras:

No, President Rajoy cannot impugn Arthur but not suspend autonomy. First, the suspension of autonomy means self-government activities are suspended as well as of the Parliament of Catalonia. And this is not allowed by the Constitution. The question of the removal of the President of the region, is a sanction of the penal code, which can only be imposed by a judge. In all cases, the President of the Government may terminate the Attorney, can file a complaint and a judge will make the decision.

Euronews:

Why, in Spain, it is not possible to make an appointment as those made in Quebec and Scotland? The Constitution does not provides?

Francesc de Carreras:

Each country has its own laws. In Spain, only referenda on the ratification of the constitutional or statutory reforms laws and, basically, it's the end of the legislative process. Today, there is a kind of referendum to the State level, proposed by the Prime Minister, with most cameras, in cases of major policy importance. In Catalonia, there are doubts about the constitutional interpretation, i.e. whether the referendum should be open to all Spanish citizens or just the Catalans. In any case, would be similar to the vote in Quebec, i.e. the referendum in Catalonia, would make it possible to begin negotiations between the State Government and the "Generalitat" to see what is the best way out for the issue.

If the referendum doesn't happen it can be a frustration for Catalan society?

Francesc de Carreras:

We can say that, in Catalan society, there is a majority that wants to talk about it, you want to vote, but there is a minority who want independence. It takes a full debate since the aftermath of the independence of Catalonia affects all, for its location in Europe, compared to their situation as a State in the world, speak about their economic situation, everything that has to be discussed in depth, not least because the Catalan media are monopolized, or heavily influenced by nationalist sectors.
